1.1SubjecttothetermsandconditionssetforthinthisRefundandReturnPolicyandtheTermsofService,Buyermayrequestthereturnofpurchaseditems("Items")and/orarefundpriortotheexpirationoftheSHOPBACKWarrantyPeriod.TermsofService.

1.2TheSHOPBACKGuaranteeisaserviceprovidedbySHOPBACKattherequestoftheUsertohelptheUserdealwithcertainconflictsthatmayariseduringthetransaction.Usersmaycommunicateprivatelywitheachothertoresolvedifferencesorcontacttheappropriatelocalauthoritiestohelpthemresolveanydisputesbefore,duringorafterusingtheSHOPBACKGuarantee.

2.ReturnRequests

2.1ABuyermayrequestarefundand/orreturnonlyif

TheBuyerhasnotreceivedtheitem.

Theitemisdefectiveand/ordamagedupondelivery.

Theitemwasreceivedincomplete(missingquantityoraccessories).

Thesellerhasdeliveredtothebuyeranitemthatdoesnotconformtotheagreedspecifications(e.g.wrongsize,color,etc.).

theitemdeliveredtothebuyerismateriallydifferentfromthedescriptionprovidedbythesellerinthelistofitems.

Theitemsreceivedarecounterfeitgoods**.

Theitemreceivedisphysicallydamaged(e.g.dented,scratched,broken).

Theitemreceivedisdefective(e.g.faulty,doesnotworkasintended).

2.2Buyer'srequestmustbesubmittedthroughtheSHOPBACKmobileapp.

2.3SHOPBACKwillrevieweachBuyer'sapplicationonacase-by-casebasisandwilldetermine,initssolediscretion,whethertheBuyer'sapplicationissuccessful.

2.4PleasenotethatifrequestedbySHOPBACK,BuyermustshipthemerchandisetothelocationspecifiedbySHOPBACKwithinten(10)calendardaysofthereturnrequest.

2.5SHOPBACK,initssolediscretion,willapproveyourrefundandreturnrequest.BuyeracknowledgesandagreesthatSHOPBACK'decisionisfinal,conclusiveandbinding,andcovenantsandagreesnottosueorotherwisebringanyclaimsagainstSHOPBACKoritsaffiliatesinconnectionwithsuchdecision.

2.6IfBuyerhasinstitutedlegalproceedingsagainstSeller,BuyermayprovideSHOPBACKwithformalnoticefromtheappropriateauthoritiesrequiringSHOPBACKtocontinuetoholdthePurchaseMoneyuntilaformaldeterminationismade,andSHOPBACKwilldetermine,initssolediscretion,whetheritisnecessarytocontinuetoholdsuchPurchaseMoney.

3.RightsofPreferredSellers

3.1IfyouareaPreferredSeller,youshouldhavereceivedseparatewrittennoticefromSHOPBACKinformingyouofyourelectiontoparticipateintheSHOPBACKPreferredSellerProgram.IfatanytimeyoudecidenottoparticipateintheSHOPBACKPreferredSellerProgram,pleasenotifySHOPBACKinwriting;otherwise,youwillbedeemedtohaveelectedtocontinuetoparticipateintheSHOPBACKPreferredSellerProgramandagreetothetermsandconditionssetforthinthisRefundandReturnPolicy.SHOPBACKmay,atitssolediscretion,suspendorremovefromtheSHOPBACKPreferredSellerProgramatanytimeSHOPBACKmaysuspendorremoveanyPreferredSellerfromtheSHOPBACKPreferredSellerProgramatanytimeinitssolediscretion.

3.2SHOPBACK'decisiontoapprovearefundorreturnunderSection2aboveshallbebindingontherelevantPreferredSeller.ThePreferredSelleragreestocomplyanddoallthingsnecessarytomakeBuyer'srequestforarefundorreturnvalidandapprovedbySHOPBACK.

3.3ForanyrefundorreturnrequestapprovedbySHOPBACK,SHOPBACKwillnotifythePreferredSellerbyemail("EmailNotification")andorganizetheshippingoftherelevantreturneditemstotheaddressprovidedinwritingtoSHOPBACKbytherelevantPreferredSellertocompletetherefundandreturnprocess,providedthattheaddressislocatedthecountryinwhichtherelevantitemislistedforsaleontheSite("LocalAddress").IfthePreferredSellerfailstoprovidealocaladdressforthereturneditemorotherwisefailstoacceptthereturnwithinareasonabletime(asdeterminedbySHOPBACK),SHOPBACKreservestherighttodisposeofsuchiteminanymanneritdeemsappropriate,andthePreferredSellershallbedeemedtohaveforfeitedallrightstosuchitem.IfPreferredSellerdoesnotreceivethereturneditem,PreferredSellermustnotifySHOPBACKwithinseven(7)daysafterreceiptoftheemailnotification("NoticePeriod")FailuretonotifySHOPBACKwithintheNoticePeriodshallbeconclusiveevidenceandshallresultinPreferredSellerhavingaccepteddeliveryofsuchitem,andPreferredSelleragreesnottoassertanyclaimagainstanysuchFailuretonotifySHOPBACKwithinthenoticeperiodwillbeconclusiveevidenceandresultinPreferredSellerhavingaccepteddeliveryoftheitem,andPreferredSelleragreesnottomakeanyclaimordisputeanysuchitem.

3.4Notwithstandingtheforegoing,SHOPBACKmay,initssolediscretion,notreturnanitemapprovedforrefundorreturntoPreferredSeller,andPreferredSellershallbedeemedtohaveforfeitedallrightstosuchitem.

3.5WithrespecttoanyrefundorreturnofmerchandisereceivedbySHOPBACKandrejectedbySHOPBACK,SHOPBACKwillorganizethedeliveryofsuchmerchandisetotheaddressoftherelevantpurchaserinaccordancewithSection2above.

3.6IfSHOPBACKapprovesanyrefundorreturnrequest,thePreferredSellermayappealthedecisionbycontactingSHOPBACKandprovidingevidencetosupporttheappeal.IfSHOPBACKsustainsthePreferredSeller'sappeal,itwillpaythePreferredSellerallorpartofthepurchasSHOPBACK.PreferredSelleracknowledgesandagreesthatSHOPBACK'decisionisfinal,conclusiveandbinding,andcovenantsandagreesnottosueorotherwisebringanyclaimsagainstSHOPBACKoritsaffiliatesinconnectionwithsuchdecision.

4.RightsofRegularSellers

4.1ForpurposesofthisRefundandReturnPolicy,aRegularSellerisaSellerwhoisnotaMallSelleroraPreferredSeller.

4.2WhenSHOPBACKreceivesarequestfromBuyerforareturnand/orrefund,SHOPBACKwillnotifySellerinwriting.SellermayrespondtoBuyer'srequestbyfollowingthestepsprovidedbySHOPBACKinthewrittennotice.Sellermustrespondwithinthetimeframespecifiedinthewrittennotice("SpecifiedPeriod").IfSHOPBACKdoesnothearfromSellerwithintheRequiredTimePeriod,SHOPBACKwillassumethatSellerhasnotrespondedtoBuyer'srequestandwillcontinuetoevaluateBuyer'srequestwithoutfurthernoticetoSeller.SHOPBACKwillrevieweachSeller'sresponseonacase-by-casebasisanddetermine,initssolediscretion,whetherBuyer'srequestislikelytobesuccessfulinthecircumstancesdescribedbySeller.

5.ReturnandExchangeSituations

5.1Inordertoenjoyahassle-freeexperiencewhenreturninganitem,Buyershallensurethattheitem,includinganyfreeitemssuchasaccessoriesprovidedwiththeitem,mustbereturnedtoSellerinthesameconditioninwhichBuyerreceiveditatthetimeofdelivery.Wewilladvisethebuyertotakepicturesoftheitemuponreceipt.

6.Liabilityforreturnshipping

(a)IntheeventofunforeseenerrorsbySeller(i.e.-damaged,defectiveorincorrectitemsdeliveredtoBuyer),SellerwillberesponsibleforBuyer'sreturnshippingcosts.

(b)IntheeventofachangeofmindbyBuyer,BuyershallobtainSeller'sconsentpriortoreturnandBuyershallberesponsibleforreturnshippingcosts.

(c)IntheeventofadisputebetweenBuyerandSellerastothepartyresponsibleforreturnshippingcharges,SHOPBACKwilldetermine,initssolediscretion,thepartyresponsibleforreturnshippingcharges.

7.Refunds

7.1BuyerwillreceivearefundonlyuponSHOPBACK'receiptofSeller'sconfirmationthatSellerhasreceivedthereturnedmerchandise.IfSHOPBACKdoesnotreceivearesponsefromSellerwithinthespecifiedtimeperiod,SHOPBACKwillhavetherighttorefundtheapplicableamounttoBuyerwithoutfurthernoticetoSeller.RefundswillbemadetoBuyer'scredit/debitcardordesignatedbankaccount,whicheverisapplicable.

8.CommunicationbetweenBuyerandSeller

8.1SHOPBACKencouragesuserstocommunicatewitheachotherwhenproblemsariseduringatransaction.SinceSHOPBACKistheplatformonwhichusersconducttheirtransactions,BuyershouldcontactSellerdirectlytoresolveanyissuesrelatedtothepurchaseditem.
